Westpower pleads guilty, ordered to pay $330,000 after fatal worksite accident

Edmonton-based Westpower Equipment Ltd. has been ordered to pay $330,000 after a worker was fatally injured at a Calgary worksite in March 2022.

Westpower plead guilty Monday in Calgary court to one charge of failing to ensure the health and safety of a worker under the Occupational Health and Safety (OHS) Act, one of 23 charges brought against Westpower under OHS legislation.

The charges stem from a work site incident on March 3, 2022, when a worker was operating an overhead crane to install a pump cover. The cover suddenly released from the rigging and struck the worker, causing fatal injuries.

The company was fined $330,000 including a 20 per cent victim fine surcharge amounting to $55,000. The Crown withdrew the other 22 charges.

Both the company and the Crown have up to 30 days to appeal the conviction or penalty.

Fatality investigation summaries are posted  60 to 90 days after court proceedings conclude.
